1. Agreement to Terms
By accessing or using FishingTactix (the "App"), available at fishingtactix.com and via the Google Play Store, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the App.
These Terms constitute a legally binding agreement between you and Kristan Hurn, trading as FishingTactix ("we", "us", "our").
2. Service Description
FishingTactix is a fishing companion application providing bite predictions, weather data, catch logging, rig suggestions, species information, tide data, venue management, and related features for recreational anglers. The App is available as a Progressive Web App (PWA) and as an Android application via the Google Play Store.
3. User Accounts
Some features of the App require you to create an account. When you create an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your password
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorised use of your account
You may use the App on up to 2 devices simultaneously. Exceeding this limit may result in automatic session termination on the oldest device.
4. Free and Pro Tiers
4.1 Free Tier
The Free tier provides access to core features including weather data, bite predictions, species cards, kit checklist, venue browsing, and 2026 regulations. No account or payment is required for the Free tier.
4.2 Pro Tier
The Pro tier unlocks additional features including cloud sync, photo catch logging, community features, rig mechanics lab, smart tactics generator, tide tables, and more. The Pro tier is available via a paid annual subscription.
4.3 Free Trial
New users receive a 7-day free trial of Pro features. No payment information is required to start the trial. After the trial expires, Pro features are restricted unless you subscribe.
5. Pricing, Payment & Subscriptions
5.1 Pricing
- Founder Pricing: £14.99/year for users who subscribe before 1 June 2026. This rate is locked in for the lifetime of your subscription.
- Standard Pricing: £19.99/year for subscriptions started on or after 1 June 2026.
All prices include VAT where applicable. Prices are displayed in GBP (£).
5.2 Payment Processing
All payments are processed securely by Stripe. By subscribing, you also agree to Stripe's Terms of Service. We do not store your payment card details.
5.3 Subscription Renewal
Subscriptions renew automatically on an annual basis. You will be charged the applicable rate (Founder or Standard) at the start of each renewal period. You can manage or cancel your subscription at any time via the Stripe customer portal, accessible from the App's Settings.
5.4 Cancellation
You may cancel your subscription at any time. Upon cancellation:
- You retain access to Pro features until the end of your current billing period
- No further charges will be made
- Your account reverts to the Free tier at the end of the billing period
- Your data remains accessible (catch logs, venues, etc.) but Pro-only features will be locked
5.5 Refunds
Refund requests are handled on a case-by-case basis. If you are unhappy with the service, contact us at kristan@fishingtactix.com within 14 days of your payment and we will issue a full refund. After 14 days, refunds are at our discretion. This does not affect your statutory rights under UK consumer law.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of fishing regulations
- Upload content that is offensive, abusive, defamatory, or contains profanity
- Attempt to gain unauthorised access to other users' accounts or data
- Reverse-engineer, decompile, or disassemble the App
- Use automated tools to scrape data or overload our servers
- Impersonate another user or misrepresent your identity
- Share or distribute copyrighted content without permission
- Use the community feed to advertise, spam, or promote unrelated products
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
7. User Content
You retain ownership of all content you create in the App, including catch logs, photos, venue notes, match reports, and profile information ("User Content").
By sharing User Content to the community feed or public profiles, you grant FishingTactix a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote that content within the App and on our social media channels. This licence ends when you delete the content or your account.
You are responsible for ensuring you have the right to share any content you upload.
8. Community Features & Moderation
The App includes community features such as catch feeds, leaderboards, venue reviews, and match reports. We use automated profanity filtering and a reporting system to maintain community standards.
We reserve the right to remove content and suspend users who violate community standards. Reports are reviewed and actioned within a reasonable timeframe.
9. Intellectual Property
The FishingTactix name, logo, BiteSync™ branding, app design, source code, algorithms (including the bite prediction engine), and all original content are the property of Kristan Hurn and are protected by UK and international intellectual property laws.
You may not copy, modify, distribute, or create derivative works from our intellectual property without written permission.
10. Data Accuracy & Disclaimers
FishingTactix provides bite predictions, weather data, tide information, and fishing regulations on a best-effort basis. While we strive for accuracy:
- Bite predictions are probabilistic estimates based on environmental factors and are not guarantees of fishing success
- Weather and tide data is sourced from third-party providers (Open-Meteo, WorldTides) and may contain inaccuracies
- Regulations data is updated to reflect current UK/EU rules but you are responsible for verifying local rules, bylaws, and licence requirements before fishing
- Species identification via iNaturalist is provided as guidance only and should not be relied upon for species with legal implications
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by UK law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- Our total liability for any claim relating to the App shall not exceed the amount you paid to us in the 12 months preceding the claim
- We are not liable for any losses arising from reliance on bite predictions, weather data, regulations, or species identification
- We are not liable for data loss resulting from device failure, browser issues, or circumstances beyond our control
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
12. Service Availability
We aim to keep the App available at all times but do not guarantee uninterrupted access. We may temporarily suspend access for maintenance, updates, or circumstances beyond our control. The App's offline mode allows continued use of cached data during outages.
13. Account Termination
By you: You may delete your account at any time via Settings in the App or by visiting our Delete Account page. See our Privacy Policy for details on data deletion.
By us: We may suspend or terminate your account if you breach these Terms, engage in abusive behaviour, or if required by law. We will provide notice where reasonably practicable.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the App or email. Continued use of the App after changes constitutes acceptance of the updated Terms. If you disagree with any changes, you should stop using the App and delete your account.
15. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, you also have the right to bring proceedings in the courts of your country of residence. Nothing in these Terms affects your statutory rights as a consumer under UK law.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
